Parliament Advances Constitutional Alignment on Presidential Succession Provisions

Zimbabwe’s National Assembly has taken a significant step towards harmonising the Constitution with existing presidential succession provisions after considering amendments made by the Senate to the Constitution of Zimbabwe Amendment (No. 3) Bill, 2026.

The deliberations took place during an extraordinary sitting of Parliament convened by President Emmerson Mnangagwa as lawmakers moved to finalise the proposed constitutional changes.

Presenting the amendments, Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi said one of the key Senate revisions removes a constitutional clause requiring a Vice President who assumes the presidency to take the oath of office.

He explained that the provision became redundant following the enactment of the Constitution of Zimbabwe Amendment (No. 2) Act, 2021, which altered the presidential succession framework.

According to Ziyambi, the amendment seeks to ensure consistency within the Constitution by reflecting the current legal position, under which Parliament is required to elect a new President within 30 days should the office of President become vacant, rather than allowing a Vice President to automatically assume the position.

The proposed change forms part of six amendments introduced by the Senate and now under consideration by the National Assembly as Parliament completes work on the Constitution of Zimbabwe Amendment (No. 3) Bill.

Beyond succession provisions, the Bill also contains proposals relating to presidential election procedures, term limits and the composition and structure of Parliament, making it one of the most significant constitutional reform measures currently before the legislature.

Lawmakers are expected to continue scrutinising the amendments as the legislative process moves towards its conclusion, with the objective of ensuring the Constitution remains aligned with existing legal and governance frameworks.
